Writersworld Publish Contract

TERMS AND CONDITIONS OF CONTRACT

WRITERSWORLD provides a publishing service and a range of associated services for authors under the Terms and Conditions set out below.

1. DEFINITIONS

1.1 " Author" means the individual or organisation who buys or agrees to publish his or her book through.

1.2 " WRITERSWORLD" means Writersworld UK Limited of 9 Manor Close, Enstone, Oxfordshire, OX7 4LU, England. Company Registration Number: 5848763

1.3 " Author " shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;

1.4 " Contract" means the contract between the Author and WRITERSWORLD for the publishing of a book incorporating these Terms and Conditions and the entire text of the PUBLISH section of www.writersworld.co.uk

1.5 " Book" means the book that the Author agrees to publish through WRITERSWORLD

1.6 "Terms and Conditions" means the terms and conditions of sale set out in this agreement and any terms and conditions contained on the PUBLISH section of www.writersworld.co.uk

1.7 "Website" means www.writersworld.co.uk

2. CONDITIONS

2.1 Nothing in these Terms and Conditions shall affect the Author's statutory rights as a Consumer.

2.2 These Terms and Conditions shall apply to all contracts for the publishing of books by WRITERSWORLD for the Author and shall prevail over any other documentation or communication from the Author.

2.3 Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by WRITERSWORLD

2.4 Any complaints should be addressed to the WRITERSWORLD address stated in clause 1.2.

3. PRICE AND PAYMENT

3.1 The price of publishing the book shall be that stipulated on the PUBLISH section of www.writersworld.co.uk. The price is inclusive of VAT and includes all publishing costs.

3.2 Payment of the publishing price inclusive of VAT may be made in full at the time of submitting this contract or pursuant to our payment plans.

4. WRITERSWORLD PRICING POLICY

4.1 WRITERSWORLD reserves the right to periodically update its publishing prices on www.writersworld.co.uk which cannot which cannot be guaranteed for any period of time. WRITERSWORLD shall make every effort to ensure prices are correct at the point at which the Author places an order.

4.2 WRITERSWORLD reserves the right to withdraw any book from the www.writersworld.co.uk at any time.

5. AGE OF CONSENT

5.1 Where the book may only be published by persons of a certain age the Author it will be deemed that when submitting the contract the Author is of the required age unless so stated by the Author.

5.2 If WRITERSWORLD discovers that the Author is not legally entitled to publish the book, WRITERSWORLD shall be entitled to cease publishing the book immediately, without notice.

6. WARRANTY

WRITERSWORLD warrants that the book (s) will at the time of dispatch correspond to the description given by WRITERSWORLD where the Author is dealing as a Consumer, all other warranties, conditions, or terms relating to fitness for purpose, merchantability or condition of the Goods, whether implied by Statute, common law or otherwise excluded, and the Author is satisfied as to the suitability of the book (s) for the Authors purpose.

7. DELIVERY

7.1 Books to be published will be published within sixty working days of payment of the publishing if the Author fully co-operates in regards to the publication of the book. WRITERSWORLD shall use its reasonable endeavours to meet any date agreed for publication. In any event time of the publication shall not be met WRITERSWORLD shall not be liable for any losses, costs, damages or expenses incurred by the Author or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

7.2 Delivery of the published book (s) shall be made to any address specified by the Author and the Author shall make all arrangements necessary to take delivery of the book(s) whenever they are tendered for delivery. The author is responsible for all shipping costs of any book delivery which will be paid for prior to delivery.

8. LIMITATION OF LIABILITY

8.1 Except as may be implied by law where the Author is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the WRITERSWORLD the remedies of the Author shall be limited to damages which shall in no circumstances exceed the money paid by the Author to publish the book and WRITERSWORLD shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

8.2 Nothing in these Terms and Conditions shall exclude or limit the liability WRITERSWORLD for death or personal injury resulting from the negligence of WRITERSWORLD or that of any WRITERSWORLD agent or employees.

9. WAIVER

No waiver by WRITERSWORLD (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

10. FORCE MAJEURE

WRITERSWORLD shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and WRITERSWORLD shall be entitled to a reasonable extension of its obligations.

11. SEVERANCE

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

12. CHANGES TO TERMS AND CONDITIONS

WRITERSWORLD shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Author at the time of signing this contract.

13. CANCELLATION OF CONTRACT BY AUTHOR

In the event of premature cancellation of the contract by the author prior to publication of the book, notice of such cancellation may be given in writing, by e-mail or by telephone. In the event of such cancellation, any refund of fees will be entirely at WRITERSWORLD's discretion and will be subject to appropriate deductions in respect of work already undertaken. If the contract is cancelled prior to publication the author agrees not to use the services of any of the WRITERSWORLD sub-contractors who have worked on the book and further agrees not to use any book cover design or copy-edited material produced by WRITERSWORLD during the preparation of the book. In addition, for the purposes of this contract, any book printer used by WRITERSWORLD is deemed to be a sub-contractor of WRITERSWORLD. In the event that the author cancels the contract to publish his or her book prior to publication WRITERSWORLD is authorised by the author to have Power of Attorney (in this matter only) to cancel any allocated ISBN number for the book which cannot be rescinded by the author. 

14. BOOK PRINTERS

The author undertakes not to use the services of any book printer that is used by WRITERSWORLD for the supply of books direct to the author, until WRITERSWORLD has been paid in full for the production of the author's book to which this contract relates.

15. GENERAL

Once the Author has submitted the work and it has been accepted and published by WRITERSWORLD, there can and will be no changes to the authors' book unless and until such changes have been approved by WRITERSWORLD and a further fee agreed between the parties commensurate with any work involved and the costs of resubmission to the printer. WRITERSWORLD reserves the right, entirely at its own discretion, to accept for publication or to reject any book or alteration thereto.

16. INTELLECTUAL PROPERTY RIGHTS

WRITERSWORLD acknowledges the authors ownership of all intellectual property rights in the book and undertakes to credit the author with the intellectual property rights on each and every copy of the book published. Further, the author's moral rights will be asserted on every copy and a statement included to the effect that the book is protected by copyright. This notice of copyright also applies to the cover. The authors name will be prominently displayed in all the usual places in the book. Nothing in this contract shall entitle the author to use or acquire any rights to the use of the name WRITERSWORLD, including (without limitation) its logo.

WRITERSWORLD cannot and will not accept liability for any breach of the author's intellectual property rights by any third party or person. By signing this contract the author declares that the book is his or her own work and that no other party or person has any interest or right in the book unless acknowledged.The author may terminate this contract at any time after the publication of the book. WRITERSWORLD hereby guarantees that upon publication of the book the author shall have the absolute right at any time to a copy of the file used to create the book, at no cost and without the need to show cause. There will be a £50.00 charge for the transfer of the copy of the file to the author. The copy of the file will be electronically delivered to the author within fourteen working days of the request for the file.

17. PUBLISHING FEES AND ROYALTIES

WRITERSWORLD will set up their own individual secure account direct with the printer, load their files onto their account and will not take a penny from them in royalties or on copies of their book they buy direct from the printer. This will allow authors to know at all times what the sales of their book are, order as many copies as they want when they want and change the retail price and contact details when they want.

18. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the law of England and Walesand the parties hereby submit to the exclusive jurisdiction of the English courts. WRITERSWORLD requests thatwhen signing this contract the author should print off the content of the dated PUBLISH page at this website and retain a copy thereof along with a copy of this contract. This is to ensure that the author will be in possession of a dated record of all the terms and conditions as they stood at the time the author entered into this contract.

19. SUBMITTING THIS CONTRACT

Either print off, fill in and sign the printer friendly version of the contract or, as a substitute, we will accept a submission using the declaration form provided below.
